By accessing or using the Service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions ("Terms"). If you do not agree to these Terms or are not eligible to use the Service, you must not use the Service.

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Ariive-eSIMs, and neither party has authority to bind the other.


1. Service Description

Ariive-eSIMs provides prepaid eSIM products that enable customers to access mobile data services without the need for a physical SIM card. Services are delivered electronically and rely on third-party mobile network operators and roaming partners.


2. Registration

By purchasing or using an Ariive-eSIMs product, you agree to these Terms and Conditions and any policies, procedures, or operational rules published by Ariive-eSIMs from time to time. Such policies are incorporated into these Terms by reference and may be amended periodically.


3. Privacy

Ariive-eSIMs is committed to protecting your personal data using appropriate technical and organisational security measures.

By using the Service, you consent to our use of information provided during registration to administer your account, provide customer support, obtain feedback, and inform you about products and services.

We may collect technical information such as device type, operating system, browser information, and IP address for troubleshooting, analytics, and service improvement purposes.

You may request correction or deletion of your personal data at any time. It is your responsibility to ensure that the information you provide remains accurate and up to date.


4. Intellectual Property Rights

All trademarks, logos, trade names, software, content, and other intellectual property associated with Ariive-eSIMs remain the exclusive property of Ariive-eSIMs or its licensors.

You may not copy, reproduce, modify, distribute, or otherwise use any intellectual property without prior written consent. Use of the Service does not transfer any ownership rights to you.


5. Ariive-eSIMs Account

5.1 Activation of Service

Upon purchase, your eSIM will be delivered electronically via email and made available for installation.

The contract will automatically terminate if no active data package is associated with the eSIM for 180 consecutive days or if the eSIM is deleted from the device.


5.2 Fees and Payments

Payments are processed securely via third-party payment providers including Stripe, PayPal, and Shopify Payments.

Ariive-eSIMs does not store or process sensitive payment card details. All payment processing is handled by PCI-DSS compliant providers.

By purchasing, you agree to the terms of your selected payment provider.


5.3 Termination

You may terminate your use of the Service at any time by deleting the application or discontinuing use.

Termination takes effect immediately and does not entitle you to a refund unless required by applicable law.

Ariive-eSIMs reserves the right to suspend or terminate access to the Service for legal, security, or operational reasons.


6. Refunds and Use of Services

6.1 Refunds and Cancellations

6.1.1 Refund Eligibility

Refund requests may be submitted within thirty (30) days of purchase where activation is not possible after reasonable troubleshooting conducted with customer cooperation.

6.1.2 Customer Cooperation

Refund eligibility requires reasonable cooperation from the customer in troubleshooting activation or technical issues.

6.1.3 Expired Data Packages

No refunds are available for unused data once a package has expired.

6.1.4 Additional Charges

Ariive-eSIMs is not responsible for any charges incurred from third-party SIMs, devices, carriers, hotel phones, or other services not directly associated with the Ariive-eSIMs account.

6.1.5 Fraudulent Activity

Ariive-eSIMs reserves the right to refuse refunds where there is evidence of abuse, misuse, or fraud.

6.1.6 Statutory Consumer Rights

Nothing in these Terms excludes or limits any rights or remedies available under applicable consumer protection laws, including the Consumer Rights Act 2015. Your statutory rights remain unaffected.


6.2 Use of Services

You are responsible for ensuring your device is eSIM-compatible and not carrier-locked prior to purchase.

Where an eSIM cannot be activated, customers may request a refund or alternative package, subject to these Terms.

If an eSIM remains unused for 180 days following purchase, Ariive-eSIMs may deactivate the eSIM. Any unused data or balance may be forfeited.

You must notify Ariive-eSIMs immediately if your device is lost or stolen.

You are solely responsible for all activity conducted through your account or device.


7. Limitation of Liability

Ariive-eSIMs shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, revenue, data, or business opportunities arising from use of the Service.

Total liability shall be limited to the amount paid for the Service in the twelve (12) months preceding the claim.

Ariive-eSIMs is not responsible for losses caused by accidental deletion of an eSIM or actions outside its control.


8. Changes to These Terms

Ariive-eSIMs may update these Terms at any time. Changes take effect upon publication on the website. Continued use of the Service constitutes acceptance of updated Terms.


9. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.


10. Third-Party Services

Ariive-eSIMs is not responsible for third-party websites, networks, or services, including mobile network operators and roaming partners.

We have no control over their availability, performance, or content.


11. Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of any rights.


12. Force Majeure

Ariive-eSIMs is not liable for failure or delay caused by events beyond reasonable control, including natural disasters, war, terrorism, labour disputes, governmental action, cyberattacks, or third-party network failures.


13. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. No warranties are given regarding uninterrupted availability, performance, or fitness for a particular purpose, to the fullest extent permitted by law.


14. Service Availability and Roaming Partners

Ariive-eSIMs relies on third-party mobile networks and roaming partners. Service quality, coverage, and availability may vary based on location, device, and network conditions.

No guarantee is given of uninterrupted or error-free service. Temporary outages or limitations may occur, and Ariive-eSIMs is not liable for resulting losses.


15. Prohibited Uses

You agree not to use the Service:

i. For unlawful or fraudulent purposes;
ii. To distribute malware or harmful code;
iii. To disrupt networks or services;
iv. To infringe intellectual property or other rights;
v. To engage in abusive or harmful behaviour;
vi. In any manner that negatively impacts other users or the Service.

Ariive-eSIMs may suspend or terminate accounts where misuse is suspected.


16. Chargebacks and Payment Disputes

If a payment is disputed or reversed, Ariive-eSIMs may suspend or terminate access to the Service until resolved.

Fraudulent chargebacks may result in permanent account termination and may be reported to relevant authorities.


17. Sanctions Compliance

You confirm you are not subject to sanctions or located in any restricted territory under applicable UK, EU, US, or international sanctions regimes.

You agree not to use the Service in violation of any applicable sanctions or export control laws.

Ariive-eSIMs may suspend or terminate the Service where required for legal compliance.


18. Consumer Rights

Nothing in these Terms excludes or limits rights that cannot legally be excluded. Your statutory consumer rights remain unaffected.


19. Severability

If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.


20. Entire Agreement

These Terms constitute the entire agreement between you and Ariive-eSIMs and supersede all prior agreements or understandings.
